Notice of the General Administration of Customs No. 66 of 2022 (Notice on Plant Quarantine Requirements for Imported Fresh Durian from Vietnam)

  In accordance with relevant Chinese laws and regulations and the Protocol between the General Administration of Customs of the People’s Republic of China and the Ministry of Agriculture and Rural Development of the Socialist Republic of Vietnam on Plant Quarantine Requirements for Fresh durian imported from Vietnam to China, the import of fresh durian from Vietnam that meets the following requirements is allowed from now on:

  I. Basis of inspection and quarantine

  (1) Biosafety Law of the People’s Republic of China;

  (2) Law of the People’s Republic of China on the Entry and Exit Animal and Plant Quarantine and Regulations for the Implementation of Law of the People’s Republic of China on the Entry and Exit Animal and Plant Quarantine;

  (3) Food Safety Law of the People’s Republic of China and Regulations for the Implementation of the Food Safety Law of the People’s Republic of China;

  (4) Measures for the Supervision and Administration of the Inspection and Quarantine of Entry Fruits;

  (5) Protocol between the General Administration of Customs of the People’s Republic of China and the Ministry of Agriculture and Rural Development of the Socialist Republic of Vietnam on Phytoquarantine Requirements for fresh durian imported from Vietnam to China.

  II. Name of goods allowed to enter the country

  Fresh Durian (hereinafter referred to as “Durian”), scientific name Durio zibethinus Murr., English name Durian.

  III. Permitted origin

  Durian production area in Vietnam.

  IV. Approved orchards and packing plants

  Orchards and packaging factories exported to China shall be registered by the Ministry of Agriculture and Rural Development of Vietnam (hereinafter referred to as “MARD”), and registered by the General Administration of Customs, PRC (hereinafter referred to as “GACC”) and MARD. The registration information includes the name, address and registration number for accurate traceability in the event that the exported goods do not comply with the relevant provisions of this Protocol. Prior to the commencement of trade, MARD shall provide the registration list to GACC, which shall be published on the official website and updated regularly upon approval by GACC.

  V. Pay close attention to the quarantine pest list

  1. Bactrocera correcta

  2.Dysmicoccus neobrevipes

  3.Planococcus minor

  4.Planococus lilacinus

  5.Pseudococcus jackbeardsleyi

  6.Exallomochlus hispidus

  VI. Pre-export management

  (1) Orchard management.

  1. The orchards exported to China should establish a perfect quality management system and traceability system under the supervision of MARD, implement good agricultural practices, maintain the sanitary conditions of orchards, such as no pollution sources affecting fruit production, timely clean up fallen and rotten fruits, and implement comprehensive pest control. Prevention and control measures include pest surveillance surveys, physical, chemical or biological control, and farm operations.

  2. MARD shall formulate management plans for quarantinable pests of concern to China according to International Standard for Phytosanitary Measures No. 6 (ISPM 6), and organize orchard monitoring throughout the year. In addition to visual inspection, a variety of physical or chemical methods should be used to trap and monitor pests.

  3. The pheromone traps were hung in orchards and yellow armyworm plates were used for physical monitoring of guava fruit flies. For scale insect pests, the branches, stems, leaves and fruits were investigated. If pests or corresponding symptoms are detected during surveillance, timely measures, including chemical or biological control, should be taken to control the occurrence of pests or maintain a low epidemic level of pests.

  4. The monitoring and control of pests in orchards exported to China should be carried out under the guidance of professional technicians. Technicians shall be trained by MARD or its authorized agency.

  5. The MARD shall maintain pest monitoring and control records in orchards and provide them to GACC when required. Control records should include the name of the chemical used during the growing season, the active ingredient, the dose used, and the time of year.

  (2) Packaging factory management.

  1. The processing, packaging, storage and shipment of durian exported to China shall be carried out under the quarantine supervision of the MARD or its authorized officers.

  2. The packing factory should be clean and hygienic, the ground should be hardened, and there should be a raw material yard and a finished product warehouse.

  3. The storage, processing, processing, storage and other functional areas of durian exported to China are relatively independent, reasonably arranged, and separated from the living areas with appropriate distance.

  4. If the packaged durians need to be stored, they should be stored immediately and separately to avoid re-infection by pests.

  5. The packaging factory shall establish a traceability system to ensure that the durian exported to China can be traced back to the registered orchard, and record the processing and packaging date, name of the source orchard or its registration number, quantity, export date, quantity, country of shipment, container number and other information.

  (3) Packaging requirements.

  1. The packing materials should be clean, unused and meet the relevant plant quarantine requirements of China. If wood packaging is used, it must meet the requirements of International Standard for Phytosanitary Measures No. 15 (ISPM 15).

  2. Durian in the process of packaging, imports have artificial selection, classification and cleaning process, such as fruit, fruit, rotten fruit, eliminate disease deformity fruit, leaf, fruit stalk or other plant residues and soil, etc., and adopt effective measures such as scrub or high pressure air gun purging clean fruit surface, clean soft cotton cloth if necessary manually wipe of durian appearance, especially in areas such as the peduncle, To effectively remove the attached eggs and pathogenic spores on the fruit surface.

  3. The name of the fruit, country of export, place of origin, orchard or its registration number, packing factory or its registration number and other information must be marked on each packing case in English or Chinese. Each packing case and pallet should be marked with the “Exported to the People’s Republic of China” in Chinese or English.

  4. Containers containing durian for export to China must be checked for good sanitary conditions when they are packed. Containers shall be sealed and in good condition upon arrival at the port of entry in China.

  (4) Quarantine before export.

  1. MARD shall conduct sampling inspection on each consignment of durian exported to China at a rate of 2% per consignment. If no phytosanitary problems occur within two years, the sampling rate will be reduced to 1%.

  2. If any quarantinable pests, branches and leaves or soil of concern to the Chinese side are found, the whole batch of goods shall not be exported to China, and the export of durian from relevant orchards and packing factories in this export season shall be suspended as appropriate. The MARD should identify the cause and take corrective action. Also, keep inspection records and provide them to GACC upon request.

  (5) Plant quarantine certificate requirements.

  If it passes the quarantine inspection, the MARD will issue the phytosanitary certificate, indicating the name or code of the orchard and packing plant, and filling in the following additional declaration:This consignment of durian fruits complies with the requirements specified in the Protocol of Phytosanitary Requirements for Export of Fresh Durians from Vietnam to China, and is free from quarantine pests of concern to China.

  Prior to the commencement of the durian import project, MARD should provide sample phytosanitary certificates to GACC for confirmation and filing.

  VII. Entry inspection and quarantine and handling of disqualification

  When the durian arrives at the Chinese port of entry, the Chinese Customs shall carry out quarantine in accordance with the following requirements.

  (1) Verification of relevant certificates and logos.

  1. Verify whether the imported durian has obtained the import Animal and Plant Quarantine Permit.

  2. Verify whether the phytosanitary certificate complies with the provisions of Article 6 (5) of these requirements.

  3. Check whether the marks on the packing cases comply with the provisions of Article 6 (3) of these requirements.

  (2) Entry inspection and quarantine.

  1. Durian for export to China should be imported from all ports where GACC allows the import of fruits.

  2. The import durian shall be inspected and quarantined in accordance with relevant laws, administrative regulations and rules, and those that pass the inspection and quarantine shall be allowed to enter the country.

  (3) Handling of non-compliance with requirements.

  1. If the durians are found to be from unapproved orchards or packing plants, they will not be allowed into the country.

  2. If quarantine pests of concern to the Chinese side or live pests of quarantine pests newly recorded in Vietnam are found, or soil or plant residues are found, the durian batch shall be removed, returned or destroyed.

  3. If it is found that the durians do not meet the national food safety standards of China, the durians shall be returned or destroyed.

  If the above non-compliance is found, GACC will notify MARD and suspend durian import from relevant orchards and packing plants in this export season. MARD shall find out the reasons and urge relevant orchards and packing plants to make rectification until relevant rectification measures are effectively implemented and approved by GACC.

  VIII. Compliance review

  Prior to the start of trade, with the assistance of MARD, GACC will send experts to conduct field visits or remote video inspections of durian production areas exported from Vietnam to China to ensure that they meet the phytosanitary requirements.

  IX. Retrospective review

  Based on the dynamics of durian pest occurrence and seizure in Vietnam, GACC will conduct further pest risk assessment and consult with MARD to adjust the list of quarantinable pests of concern to China and relevant quarantine measures.
