Mofcom: Continue to impose 5-year anti-dumping measures on imports of oriented electrical steel from Japan, The Republic of Korea and the EU

        According to the Anti-dumping Regulations of the People’s Republic of China, the Tariff Commission of The State Council has decided to continue to impose anti-dumping duties on imports of oriented electrical steel from Japan, the Republic of Korea and the European Union for five years starting from July 23, 2022. The Ministry of Commerce issued notice No. 22 of 2022, specifying the specific scope of products subject to anti-dumping measures and the corresponding anti-dumping rates. In order to implement the above trade remedy measures, the requirements for declaration of relevant commodity numbers are hereby announced as follows:

        When declaring imported oriented electrical steel (tariff code 72251100), “oriented electrical steel with a width of 600 mm and above shall contain at least 0.6% silicon by weight, not more than 0.08% carbon, and may contain not more than 1.0% aluminum. The proportion of other elements does not make it have the characteristics of other alloy steels; Thickness not exceeding 0.56 mm; If it is rolled, it can be of any width; If it is plate shaped, its width should be at least 10 times of its thickness “, the product number should be given as 72251100.10; “Other oriented silicon electric steels of width 600 mm and above”, the commodity number should be given 72251100.90.

        Import content consignee or its agent in import declaration oriented electrical steel (tariff no. 72261100), the width of less than 600 mm oriented electrical steel, silicon content of at least 0.6% by weight, the carbon content less than 0.08%, can contain not more than 1.0% of the aluminum, the proportion of other elements contained does not exhibit the characteristics of other alloy steel; Thickness not exceeding 0.56 mm; If it is rolled, it can be of any width; If it is plate shaped, its width should be at least 10 times of its thickness “, the product number should be given as 72261100.10; “Other oriented silicon electric steel with width less than 600 mm” should be marked 72261100.90.

        I. Review and adjudication

        The Ministry of Commerce ruled that if the anti-dumping measures are terminated, dumping of imported oriented electrical steel from Japan, The Republic of Korea and the European Union against China may continue or re-occur, and damage to China’s oriented electrical steel industry may continue or re-occur.

        II. Anti-dumping measures

        According to the regulation of the antidumping regulations article 50, the Ministry of Commerce according to the survey to the tariff commission of the State Council put forward the suggestion that continue to impose anti-dumping duties, the tariff commission of the State Council on the recommendation of the Ministry of Commerce decided that since July 23, 2022, over the import of native to Japan, South Korea and the European Union orientation electrical steel continue to impose anti-dumping duties, The implementation period is five years.

        The anti-dumping duty shall be levied on the products to which the original anti-dumping measures are applied, which is consistent with the product scope specified in the Announcement No.33 of the Ministry of Commerce in 2016. Details are as follows:

        The product falls under the Import and Export Tariff of the People’s Republic of China (2022):72251100、72261100.

        The continued imposition of anti-dumping duties shall be subject to the same rate as stipulated in the MoFCOM Announcement No. 33 of 2016.

        During the investigation, Nippon Steel & Sumijin Corporation submitted an application to the investigation authority, stating that Nippon Steel & Sumijin Corporation had changed its name to Nippon Steel & Sumijin Corporation on April 1, 2019, requesting the investigation Authority to replace the original company name with the changed company name in the final review ruling. After review, the investigation authority decided to accept the company’s name change application, agreed to NIPPON STEEL CORPORATION (NIPPON STEEL & AMP;; NIPPON STEEL) successor NIPPON STEEL & AMP;; Sumitomo Metal Corporation) of the 45.7% anti-dumping duty applicable to the original anti-dumping measures and other rights and obligations. Nippon Steel & AMP; Oriented electrical steel products exported to China under the name of Sumitomo Metal Corporation shall be subject to the same anti-dumping duty rate of 45.7% as applied to “other Japanese Companies” in the original anti-dumping measures.

        Japanese Company:

        1.JFE Iron & Steel 39.0percent

        (JFE Steel Corporation)

        2. Nippon Steel Corporation 45.7 percent

        (NIPPON STEEL CORPORATION)

        3. Other Japanese companies: 45.7 percent

        (All Others)

        Korean Companies:

        1. POSCO has an anti-dumping duty of 37.3 per cent. Mofcom decides to continue to implement price undertakings for the products under investigation imported by POSCO from July 23, 2022 in accordance with moFCOM Announcement No. 11, 2018. Unless suspended in advance, price undertakings shall remain valid until the date of termination of the anti-dumping measures. During the period of implementation of the price undertaking, no anti-dumping duty will be imposed on oriented electrical steel imported from POSCO. In the event of a breach of a price undertaking or other termination of a price undertaking, an anti-dumping duty shall be imposed at the aforesaid rate.

        2. Other Korean companies 37.3 percent

        Eu Companies:46.3 percent

        III. Methods for levying anti-dumping duties

        Starting from July 23, 2022, importers should pay corresponding anti-dumping duties to the Customs of the People’s Republic of China when importing oriented electrical steel from Japan, the Republic of Korea and the European Union. The anti-dumping duty shall be levied on an AD valorem basis based on the customs customs value approved by the customs. The calculation formula is as follows: the anti-dumping duty = customs customs value × the anti-dumping duty rate. VAT on import links shall be levied on an AD valorem basis based on the customs customs value plus customs duties and anti-dumping duties.
