Notice on the Phytoquarantine requirements of imported Lao Tuckahoe and Suberect spatholobi

        In accordance with relevant Chinese laws and regulations and the Protocol of the General Administration of Customs of the People’s Republic of China and the Ministry of Agriculture and Forestry of the Lao People’s Democratic Republic on the PhytoQuarantine Requirements for Soil Poria Cocos and Caulis Spatholobi Exported from Laos to China, imports of soil Poria Cocos and Caulis Spatholobi that meet the following requirements are allowed from now on:

        I. Inspection and quarantine basis

        (1) Biosafety Law of the People’s Republic of China;

        (2) the entry and exit animal and plant quarantine law of the People’s Republic of China, the law of the People’s Republic of China on entry and exit animal and plant quarantine law regulations on the implementation of the food safety law of the People’s Republic of China the food safety law of the People’s Republic of China regulations on the implementation of the law of the People’s Republic of China on import and export commodity inspection, the implementation regulations of the law of the People’s Republic of China on import and export commodity inspection;

        (3) Measures for Quarantine Supervision and Administration of Imported and Exported Chinese Medicinal Materials;

        (4) Protocol between the General Administration of Customs of the People’s Republic of China and the Ministry of Agriculture and Forestry of the Lao People’s Democratic Republic on PhytoQuarantine Requirements for Poria cocos and Caulis Spatholobi Exported from Laos to China.

        II. Allow the import commodity name

        The soil poria cocos in this announcement refer to dried rhizoids or rhizoid sections of Smilax glabra Roxb., Liliales:Smilacaceae, of the order Smilax Glabra roxb., cultivated and processed in Laos for Chinese medicinal materials. Caulis Spatholobus suberectus Dunn (Fabales: Fabaceae) is a dried vine stem or vine stem section of Spatholobus suberectus Dunn (scientific name: Fabaceae) grown and processed in Laos for Chinese medicinal materials.

        III. Enterprise registration

        The cultivation, production and processing enterprises exporting soil poria cocos and caulis spatholobi to China shall be under the supervision of the Lao authorities and comply with the requirements of the relevant laws and regulations of China and Laos.

        Enterprises engaged in the production, processing and storage of Tuckahoe and Caulis spatholobi exported to China shall be recommended by the Ministry of Agriculture and Forestry of Laos (hereinafter referred to as “Lao Fang”) to the General Administration of Customs of the People’s Republic of China (hereinafter referred to as “Chinese Side”), and the Chinese side shall register them in accordance with relevant regulations. An enterprise may not import its products into China unless it is registered in the Chinese side.

        IV. Pests of concern

        Soil poria cocos exported from Laos to China shall not contain the following quarantine pests of concern:

        1. Cuscuta spp.

        2. Mikania micrantha Kunth

        The following quarantine pests of concern shall not be included in the shipment of suberect spatholobi from Laos to China:

        1. Heterobostrychus aequalis

        2. Trogoderma granarium

        3. Cuscuta spp.

        4. Mikania micrantha Kunth

        The soil poria coho and Caulis spatholobi exported from Laos to China should not contain any impurities such as live insects, weed seeds, soil, plant residues and gravel.

        V. Requirements for product production and export

        (1) Production, storage and transportation.

        1. Under the supervision and guidance of Lao Fang, planting bases, processing and packaging plants of soil Tuckahoe and suberect spatholobi for export to China should take systematic management and comprehensive measures to control pests and diseases, including epidemic monitoring, comprehensive prevention and control, and postpartum treatment, and keep relevant records. The monitoring and control of harmful organisms in enterprises should be completed under the guidance of technical personnel. The technical personnel shall be trained by the training institution authorized by the Lao Party.

        2. The Lao side shall conduct safety monitoring of pesticide residues, heavy metal pollutants and other toxic and harmful substances in the producing areas of Tufuling and Subspatholobi, and provide the monitoring information to the Chinese side.

        3. Once a quarantine pest of concern to the Chinese side is found, the Lao side shall immediately suspend the export of the company’s products and report the situation to the Chinese side. The Lao side should urge the enterprise to make rectification, and the export of its products to China can be resumed only after the enterprise’s rectification is qualified and confirmed by the Chinese side.

        4. All exported soil Tuckahoe and suberect spatholobi must be dried by drying, not by airing.

        5. Each batch of soil Tuckahoe and suberspatholobi exported to China shall be fumigated. The fumigation indicators are as follows:

        6. Export soil poria cocos and Suberect spatholobi should be packaged with new materials in line with international health standards. The words “This product is exported to the People’s Republic of China” should be clearly marked on the package in Chinese, and the following contents should be indicated in Chinese: commodity name and scientific name, specifications, production date (year/month/day), batch number, storage conditions, production mode, production address, manufacturer’s name and registration number.

        7. The pre-packaged Chinese labels of Tuckahoe and suberathobi exported to China should meet the label requirements of pre-packaged food imported from China.

        8. The whole process of packing, storage and transportation of Tuckaho and Caulis spatholobi for export to China should comply with the relevant health requirements of China and Laos to prevent contamination by pathogenic microorganisms or toxic and harmful substances. Before SHIPMENT, transportation tools should be thoroughly inspected, disinfected and killed to prevent harmful organisms from mixing.

        (2) Pre-departure quarantine and certificate requirements.

        The old Party shall quarantine each batch of soil poria cowards and suberspatholobi and issue a phytosanitary certificate indicating fumigation temperature, time and concentration. The phytosanitary certificate is printed in Chinese and English (English must be filled in when filling in the certificate). The sample certificate shall be filed with and approved by the Chinese side. If there is any change in the content and format of the sample certificate, the Lao side shall file with the Chinese side for record at least one month before it takes effect.

        VI. Entry inspection and quarantine

        (1) Certificate verification.

        1. Check whether the Quarantine Permit for Entry Animals and Plants is attached;

        2. Check whether it comes from a registered enterprise;

        3. Verify the validity of plant quarantine certificate.

        (2) Inspection of goods.

        According to the relevant laws, administrative regulations, rules and regulations, and in combination with Article 4 and Article 5 of these requirements, the inspection and quarantine of the entry soil poria cowards and caulis spatholobi shall be carried out. Those who pass the inspection and quarantine shall be allowed to enter the country.

        VII. Handling of non-conformity

        For products that do not meet the requirements of the Chinese side, the Chinese side may return, destroy or otherwise dispose of the relevant products in accordance with the law. In addition, in accordance with the regulations of the Chinese side, the production enterprises that have serious problems or repeatedly have unqualified problems will be subject to stricter supervision or import ban.

        The two sides should establish an efficient information notification mechanism, cooperate to investigate and deal with the existing problems, and take corrective and preventive measures in a timely manner to ensure that the exported Tuckahoe and Suberect spatholobi continue to meet China’s requirements.
